　　公司：company;corporation;firm 企业：enterprise;establishment;business;company公司：是指依法定程序设立，以营利为目的社团法人。公司按股东对 公司债权人所负的责任分为unlimited company, limited company, two join company, stock company。公司的具体特征有：(1)必须依法设立(2) 以营利为目的(3)必须具备法人资格。《公司法》规定，有限责任公 司和股份有限公司是企业法人。说明公司属于企业范畴。 企业：泛指一切从事生产、流通或者服务活动，以谋取经济利益的经 济组织。按照企业财产组织方式的不同，企业在法律上又可以分为三 种类型：第一种是proprietorship,即由单个主体出资兴办、经营、管 理、收益和承担风险的企业；第二种是partnership enterprise,即由 两个或者两个以上的出资人共同出资兴办、经营、管理、收益和承担 风险的企业；第三种是 company enterprise,即依照《公司法》设立 的企业。
